The Brazilian National Agency of Petroleum, Natural Gas and Biofuels (ANP) updated its risk classification of economic activities under ANP oversight, in accordance with Decree n. 10.178/2019. Seven activities are now treated as low-risk and one activity as moderate-risk.



Resolution n. 839/2021 from the Brazilian National Agency of Petroleum, Natural Gas and Biofuels (ANP) revised the risk classification of economic activities supervised by ANP, in accordance with Decree n. 10.178/2019. The resolution determines maximum time for liberation of activities, depending on their risk. The resolution replaced ANP Resolution n. 826/2020, reported in the 16th edition of the Regulatory Report.

The revision provided by the new resolution included six activities to the low-risk level “I” classification (exempt from public act of liberation) and classified one activity under moderate-risk level “II” (simplified administrative treatment). The resolution also provided regulatory modifications aligned to that revision. Altogether, seven activities are classified as low-risk; one activity as moderate-risk; and 65 activities are classified as high-risk level “III” (complete authorization process – public act of liberation required).
