The Brazilian Electricity Regulatory Agency (ANEEL) submitted a regulatory impact analysis to public consultation intended to simplify and optimize the procedures for acquiring grants (REN n.º 876/2020), applicable to wind and photovoltaic generation over 5 MW in capacity.
Public Consultation n.º 56/2021 from the Brazilian Electricity Regulatory Agency (ANEEL) seeks to collect public contributions to a regulatory impact analysis that presents 13 proposals to modify Normative Resolution n.º 876/2020, which regulates the procedures for requesting and acquiring grants for energy generation over 5MW in capacity, applicable to wind (“EOL”) and photovoltaic (“UFV”) generators. The proposed changes seek to simplify the granting process and optimize the document submission procedures, as a means to ensure that the approved granting applications (DROs) will be carried out, and reduce regulatory costs within the granting process.
According to ANEEL, as of August 2021, the number of DROs within the Free Contracting Environment (ACL, in the Portuguese acronym) for EOL and UFV generation is 70% higher than the total number of applications from 2020, and 285% higher than the total from 2019, while a significant part of approved grants for EOL and UFV generation have not initiated construction or are overdue. The improvement of REN n.º 876/2020, therefore, seeks to safeguard implementation in an expanding environment for EOL and UFV generation.
