The Federal Government, through Decree n. 10.672/2021, regulated the legal changes provided in 2020 to the Brazilian Ports Law (Law n. 12.815/2013). The update established simplified rules for the concession of ports and the temporary cession of port areas by port authorities.
The Federal Government enacted Decree n. 10.672/2021, incorporating the regulatory simplification measures provided by Law 14.047/2020, which altered the Brazilian Ports Law (Law n. 12.815/2013), to Decree n. 8.033/2013, which regulates the Brazilian Ports Law. The modifications to the Brazilian Ports Law were covered by the 15th edition of the Regulatory Report.
The simplification measures incorporated by the new decree relate to the rules for port concessions through public calls, instead of public biddings, when only one interested bidder is identified; and the rules for temporary cession of port areas by port authorities, which require the port authority to conduct a selection process, instead of public biddings, when more than one interested company is identified.
The simplification measures seek to facilitate investments and business activities in Brazilian ports.
